VanderWall Brothers Terms & Conditions of Sale. Effective 09-28-2026. Replaces all prior terms.

Part 1 applies to every sale. Part 2 adds terms for Manufactured Products, and Part 3 adds terms for Hearth & Retail.

Part 1: Terms for all sales

1. Payment & Accounts

Sales are Cash on Delivery (COD), cash in advance (prepaid), debit card, check, cash, or credit card. A 3% processing fee applies to credit card transactions only. No fee applies to debit card, check, or cash payments.

Masons, landscapers, and builders may apply for an account by completing a credit application; we will confirm approval in writing. Account terms are net 30 from the invoice date (not the statement date), and statements are sent at the close of each month. A tax-exempt form must be on file for all resellers, industrial processors, and non-profit accounts, and a credit limit is set for each account. Past-due accounts are charged 1.5% per month plus any collection costs, and move to COD terms. A check returned for Non-Sufficient Funds (NSF) carries a $75 fee, and the account moves to COD. New orders will not be placed while an account is past due. An account in good standing is current, with no past-due balance.

2. Estimates, Prices, Taxes & Freight

An estimate remains an estimate until confirmed and is then converted into a sales order.

All prices are subject to change without notice. Unless agreed otherwise in writing, prices and quotes are FOB (Free On Board) our shipping point (Spring Lake, MI for Manufactured Products): the price covers product at that point, and freight to your site is your responsibility. You are also responsible for sales tax, fuel charges, and, where they apply, pallet charges and permit and inspection fees. Exempt sales require a valid tax-exempt form at the time your estimate or sales order is signed.

3. Returns (All Segments)

Returns are accepted within 6 months of purchase with the original sales receipt, subject to inspection before credit is issued. Returned product must be regularly stocked inventory in resalable condition and original packaging, and is subject to a 25% restocking fee. Discontinued product, opened product, and product purchased more than 6 months ago cannot be returned. Stone (natural or manufactured) must be returned in unopened, full boxes.

Special-order and custom products are not returnable unless they can be returned to the vendor. Returnable items follow the return policy above, plus shipping costs and a 10% handling fee.

We do not issue cash reimbursements. After we review the returned product, customers with an account in good standing receive a credit to their account. All other customers receive a check for the approved amount.

4. Cancellations

All cancellations must be submitted in writing before the order is placed or manufactured. Special-order and custom product cannot be canceled once production has begun or the order has been placed with the manufacturer, and you are responsible for full payment including freight.

5. Delivery & Freight Claims

Please inspect your order at the time of delivery:

1. Check that all items on the packing slip or bill of lading are present.
2. Inspect visible surfaces for shipping damage before you sign anything.
3. Note any shortage or damage directly on the bill of lading or packing slip before the driver leaves, and take photos.
4. Signing confirms you received the complete order in good condition. Claims cannot be honored after the carrier has left unless noted at delivery.

If you pick up your order from VanderWall Brothers, you are responsible for supervising loading and unloading and for securing the load for transport. VanderWall Brothers is not responsible for personal injury, property loss, or other loss resulting from loading, delivery, or unloading, including items that shift during transport.

6. Governing Law & Questions

Part 2: Manufactured Products

These terms apply to concrete and hardscape products VanderWall Brothers manufactures, including gray block, architectural block, segmental retaining walls (SRWs), and pavers.

7. Special Orders

Specialty and architectural block, non-stocked SRWs, and paver products require four weeks' notice and up to eight weeks for production.

1. You sign a sales order confirming product details, quantities, and color before production begins.
2. A non-refundable set-up fee applies, separate from the product cost.
3. You are responsible for determining the quantity to be manufactured.
4. Concrete varies naturally, and colors may differ from displayed samples. When color matching is required, we recommend a job-site sample.

Customers with an account in good standing do not need to make a down payment on Manufactured Products special orders.

8. Returns: Manufactured Products

Returned product must be repalletized in resalable condition. Damaged product is not accepted. Site pick-up for returns is available at regular delivery rates; product must be ready for quick retrieval or it will not be picked up.

9. Warranty: Manufactured Products

VanderWall Brothers manufactures its products to ASTM standards. This warranty covers the product itself as manufactured. Product not manufactured by VanderWall Brothers is covered by the manufacturer's warranty, not ours. Because we do not control how a product is installed or used after purchase, we do not guarantee finished work performed by others.

Part 3: Hearth & Retail

These terms apply to fireplaces, stoves, gas logs, and other hearth products, including installation, as well as outdoor living and other retail goods and stone and masonry supplies sold at the counter.

10. Fireplace, Stove & Stone Orders

Fireplace, stove, stone, and special orders require a 50% deposit before work begins. The remaining balance, including freight, labor, and any applicable permit fees, is due at installation or delivery.

11. Retail Goods

Stocked outdoor living products, other retail goods, and stone and masonry supplies purchased at the counter are paid at the time of purchase and follow the standard return terms in Section 3. Special orders require the 50% deposit in Section 10.

12. Warranties

Installation labor is warrantied by VanderWall Brothers for 12 months from the original installation date. We do not warranty labor if the unit was later installed or altered by others. Gas logs, fireplaces, stoves, and other products we do not manufacture are covered by the manufacturer's warranty.

Labor to install a warranty replacement part is billed at our regular service rates.

13. Stone Orders

All stone orders require a 50% deposit before the start of the job or order. Custom stone orders ship directly from the manufacturer and, once placed, cannot be canceled (see Section 4).

Because natural quarried stone and manufactured stone both vary, the color of your delivered product may differ from displayed samples or hues.

14. Liability

As the buyer, you accept responsibility for your purchased product upon delivery. If you install your own fireplace after purchase, you must sign a separate release form confirming that VanderWall Brothers is not liable for any issue resulting from self-installation. VanderWall Brothers will not service any unit we did not install, due to potential code and installation issues we cannot verify.
